Definitions
· "we", "us" and "our" refers to Associated Taxis
· "you ", "your " and "user" refers to the person booking a journey via our Passenger App, similar applications, or software (together referred to as “Software”).
· "Driver" refers to the Driver that is selected for your journey.
Limitations on Use of Software All Software, information and data provided by us and used by you to make a booking remains our property and is considered as Confidential Information. You warrant that no copyrighted details of the Software will be used other than for the purpose it is intended to be used for and will not be copied or passed on to third parties at any time. We do not warrant that the use of the Software will be uninterrupted or error-free; or that the Software and/or the information obtained from the Software will be accurate or meet your requirements. Warranties You guarantee that you have authority to enter into this agreement and to use our Software in accordance with the terms and conditions of this agreement. You agree to be financially responsible for all your use of our Software as well as for the use of your name and payment method to pay for services and products purchased using our Software. You agree to indemnify us for any breaches of the foregoing warranties. Terms of Service These terms and conditions apply to the booking service provided by us. Please note that in using our service:
· You must be registered with us to use our services.
· You are responsible for your login credentials for the services, we will not be liable for any unauthorized bookings made using your login credentials.
· You warrant that all information provided by you to us is true, accurate and up to date.
· You warrant that any payment details held in your secure wallet and/or provided to us are true and accurate and you warrant that you have authority to use those methods of payment.
· You will make payment in full when we provide services to you.
· You are responsible for any bookings made by you using our Software and we will not be liable for any costs due to bookings made on your account.
· You will only use the service to make a booking you wish to make, if we deem that you are misusing the Software, we reserve the right to disable your account without prior notice.
· You will not use the service for any unlawful purpose including (but not limited to) knowingly introducing viruses, trojans and logic bombs or attempting to gain unauthorized access to the site or its systems including servers and Databases.
· We can amend these terms and conditions to reflect any changes to the services that we provide over time. We will inform you when these changes occur.
· We offer the facility to rate your journey upon completion. This is intended for you to provide an opportunity to evaluate the quality of service being provided so that we can keep providing an excellent service. All ratings that we see to be obscene, threatening, abusive or in any way malicious will be deleted and we will suspend the associated user account.
Prices and Fares
All prices and fares are Fixed for the journey booked by you using the Software. Your booking is your acceptance of the Fare displayed by the Software. It is your responsibility to ensure that all passenger details and all journey details including the Pick- Up address, the Destination address and, any Via addresses are accurate. These prices and fares are for the booked journey only and do not include any extras (more detail below).
Extras
You undertake to pay your Driver for all extra charges incurred by your Driver completing your booked journey, these may include but are not limited to:
· Additional mileage charge if you make changes to the journey once inside the vehicle, for example if you add a via or change the destination.
· Third party fees such as airport terminal drop or collect charges, toll charges or car parking fees none of which are included in the displayed fare.
· Waiting time beyond six minutes if your booked journey involves waiting other than in traffic.
· A foul fee not exceeding that contained in the table of extras listed by the relevant licensing authority.
Payments, Cancellations and Refund Policy
Payment is taken in full at the time of booking using the Software with funds being held securely by the payment gateway merchant (currently OPAYO) until journey completion.
Cancellations made at any time by you or by us before your Driver has been dispatched trigger an automated full refund of the fare from the payment gateway merchant to the card issuer (the card used by you). That refund is processed in accordance with bank bulk system processes, currently two working days after the day of cancellation.
Refunds will not generally be made once the journey has been completed or if the driver attends the booked pick-up address and the passenger is not present.
Electronic Communications All communications with us will be done electronically whenever you use Software provided by us or send emails to us. You agree to receive communications from us by texts (to the UK registered mobile number registered by you in the Software), through notifications in our Software and by email where appropriate. All communications from us will be regarding your journeys or promotions that relate to our service. General If a Clause of the Agreement is determined by any court or other competent authority to be unlawful and/or unenforceable, the other Clauses of the Agreement will continue in effect. If any unlawful and/or unenforceable Clause would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the Clause will continue in effect (unless that would contradict the clear intention of the parties, in which case the entirety of the relevant Clause will be deemed to be deleted). The Agreement will be governed by and construed in accordance with the laws of England and Wales; and the courts of England will have exclusive jurisdiction to adjudicate any dispute arising under or in connection with the Agreement.
